Alternative Dispute Resolution (ADR) has experienced significant growth in the past decades, particularly through arbitration, settling in as a compelling alternative to traditional court litigations. However, the conventional distinction between court litigation and ADR warrants reconsideration. Perhaps it's time to redefine the divide to one between adjudication and amicable dispute resolution. Factors such as parties' expectations, the resolution process, attainable solutions, and the execution of outcomes differ markedly between these two methods. Notably, arbitration has evolved, losing some of its original strengths as an alternative dispute resolution method and aligning more closely with litigation. In our rapidly changing world, businesses' evolving expectations challenge conventional norms, prioritizing timely resolution. This session aims to redefine ADR as amicable dispute resolution, delving into various methods and assessing their effectiveness and efficiency in meeting parties' objectives.

Kyongwha Chung

Kyongwha Chung is an Of Counsel of Covington’s International Arbitration Practice Group. Ms. Chung represents both states and corporate clients in complex international disputes, drawing upon her expertise in public and private international law, international investment law, international arbitration and international mediation. She serves as counsel before numerous international tribunals and advises on commercial and investment treaty cases. She has represented clients in international arbitrations under the ICC, LCIA, SIAC, HKIAC, KCAB, JCAA, ICSID, and UNCITRAL rules, and international mediations. Her practice spans a range of jurisdictions and industries.

Ms. Chung is a regular speaker and writer on various topics in international arbitration, mediation and investment treaty disputes. Ms. Chung is dual-qualified as a Korea attorney and a United States (New York) attorney. She received her law degrees (LL.B. and M.A.) from Korea University and an LL.M. from Harvard Law School where she received Roger Fisher and Frank E.A. Sander prize for her thesis.

She authored the Korea chapter in International Handbook on Commercial Arbitration edited by ICCA (2018), participated in the drafting process of the Korea chapter in the Asia Arbitration Handbook edited by Michael Moser (2011) and the full-length treatise on arbitration in Arbitration Law of Korea: Practice and Procedure (Juris Publishing, 2012).

Thomas Allen

Thomas G. Allen is a partner and member Kilpatrick Townsend’s Energy, Construction and Infrastructure, and Complex Commercial Litigation Teams. He is based in Washington D.C. and serves as the firm’s Global Lead for International Disputes.  Prior to joining Kilpatrick, Tom was an international arbitration and dispute resolution partner in the Washington, D.C. offices of two Global 100 law firms. Tom is a frequent lecturer on international legal topics and is a former adjunct professor at American University, Washington College of Law. He currently serves as a Vice Chair of the Dispute Resolution and Arbitration Committee of the Inter-Pacific Bar Association and is a member of the roster of arbitrators for the Japan Commercial Arbitration Association. Tom is also a member of the board of directors for the Washington Lawyers’ Committee for Civil Rights and Urban Affairs.

Herman Knott

Hermann Knott is an experienced transactional and dispute resolution lawyer based in Cologne, Germany. He is a member of both the German and the New York Bar and a partner with KUNZ Lawyers, the dynamic medium-sized firm with an expanding international practice which he leads. After his legal education at law schools in three countries Hermann started his professional career with a New York law firm where he was involved in US investments in the post iron-curtain world. He then joined a German internationally oriented firm where he was also handling corporate litigation. He continued his career as a founding member of the law firm associated with a global multidisciplinary organization where he specialized in cross-border transactions. Sapna Jhangiani

Sapna Jhangiani KC has over two decades’ experience in appearing before courts and tribunals, and sitting as a neutral, in complex commercial disputes seated all over the world. She has practised in London, New York, Dubai and Singapore and is dual-qualified as an English barrister, and an advocate and solicitor of the Supreme Court of Singapore. She holds an undergraduate degree from Oxford University, and a diploma in international commercial arbitration from Queen Mary University, London, in which she graduated with distinction.

Sapna is consistently ranked in the leading legal directories, and was recognised by Asian Legal Business as one of Asia’s top 15 female lawyers. She was also included in the inaugural list of "Asia's top 100 Lawyers" published by the Asia Law Business Journal. Sapna is currently International Legal Counsel at the Attorney-General’s Chambers, Singapore, during which period she maintains a practice as arbitrator and mediator.
