Session I - Case Study

Case 1: Vessel “A” was collided with Vessel “B” and the Vessel A sunk into the sea together with all the cargo on board. All the 7 crews on board A also died. The blameworthy for A : B is 30 : 70. How are the claims of the cargo owner and the diseased under your laws ?

Case 2: Vessel A arrived in the discharging port before the Bills of Lading arrives, but the Time Charterers request the Owners as the carrier to discharge the goods without producing the B/L. How can the Owners response to the Charterers and protect their interest under your laws ?

Session II – Non-contentious Matters

Question 1: What is the most favorable point for the Owners in your flag ? Do the Owners have to establish their office or subsidiary in your country to obtain your flag ?

Question 2: How scheming the ship finance under your country ?

Question 3: At the sales and purchase of the vessels, does your flag accept the register of the new ownership by submitting the Bill of Sale as PDF by email ?

Shinsuke J. Sugiyama

Biography

Former Vice Minister for Foreign Affairs, Japan / Former Ambassador Extraordinary and Plenipotentiary of Japan to the United States of America

Shinsuke J. Sugiyama was announced as ambassador to the United States in  January 2018. His diplomatic career with the Japanese Ministry of Foreign Affairs (MOFA) spans over 40 years. He recently served as the Vice Minister for Foreign Affairs. Previous positions include Deputy Director-General of the Middle Eastern and African Affairs Bureau as well as the International Cooperation Bureau; Director-General for Global Issues, including Ambassador for Climate Change; and Director-General of the Asian and Oceanian Affairs Bureau. Sugiyama has also held leadership positions within the Foreign Policy Bureau and Treaties Bureau of MOFA. His overseas assignments have included multiple positions at the Embassy of Japan in Washington, DC; Political Minister at the Embassy of Japan in Korea, and Deputy Chief of Mission at the Embassy of Japan in Egypt. He entered MOFA in 1977. Ambassador Sugiyama studied at Waseda University in Japan and Oxford University in the UK. He has taught international law for many years at the law faculty of Waseda University, as well as at many other schools in Japan and overseas, and has written numerous law articles, edited books on international law, and served as a member of the editing committee of the international law journal issued by the International Law Association of Japan.

Yosuke Tanaka

Yosuke Tanaka is Attorney-at- Law qualified in Japan and the main partner of Tanaka & Partners, LPC. (https://tylpc.jp). He has been working as a maritime lawyer for more than 30 years in the area of marine casualty, international litigation or arbitration, ship finance and escrow agent for ship sales etc. He obtained LL.M. at University of London (UCL) in 2003 and has been teaching Japanese Maritime Law in Kwansei Gakuin University in Kobe from 2017 and Japanese company Law at Waseda University from 2021, for both of which as a part time lecturer .
